On June 21st, the United States District Court for the Northern District of Texas imposed a preliminary injunction as part of ongoing litigation between 360 Degrees Education, LLC and the Department of Education.
The temporary injunction prevents the federal government from enforcing regulations that reduced the maximum length of Gainful Employment (GE) programs to 100% of a state’s minimum educational requirements for licensures. This means that institutions will adhere to the regulations established prior to July 1st, which limited the maximum program length to “150 percent of a state’s minimum educational requirements for licensure, or 100 percent of the requirements of an adjacent state, whichever is greater.”
Due to the delays with the 2024-25 FAFSA, the National Association of Student Financial Aid Administrators (NASFAA) has issued a call to action to pressure Congress to require that the Department of Education change the deadline for institutions to report their FVT/GE data from October 1, 2024 to July 2025. NASFAA recommends that participants contact the offices of their Senators and House Representatives as well as send letters advocating for the deadline extension. While the new Program Length regulations are litigated in the courts, it is still important for financial aid offices to prepare for FVT/GE data reporting. Institutions should review the latest version of the NSLDS Financial Value Transparency and Gainful Employment (FVT/GE) User Guide for additional support to ensure that they are in compliance with the federal requirements.
